Conditional bail has been granted and an appeal launched following the magistrate's decision in Dubbo Local Court on Wednesday.
Matthew Strudwick, of Twickenham Drive, was granted bail with conditions, in the lead up to his appearance in District Court on December 1.

A history of repeat driving while disqualified offences has landed a 24-year-old Dubbo man in jail.
Matthew Strudwick, of Twickenham Drive Dubbo, pleaded guilty to driving a motor vehicle whilst disqualified at Dubbo Local Court on Wednesday.
According to the facts at about 10.35pm on July 9 police were patrolling east bound along Erskine Street when they became suspicious of a black Subaru Impreza which entered Dubbo Hospital and left a short time later and began travelling east along Coborah Road.

Police pulled over the Mr Strudwick, who, according to facts presented to the court, exited the drivers seat and approached police stating "I'm just letting you know, I don't have a licence".
He was requested to remain in the vehicle. According to the facts the Subaru also contained a female passenger who had a full licence, and when asked why he was driving he responded, "I just wanted to drive ...".
Mr Strudwick's defence stated he was aware he faced a term of imprisonment "if he continues down this path" and that he was "really wearing his chances out".
However the defence said he was remorseful, and this is shown by his early plea of guilt.
Magistrate Gary Wilson highlighted Mr Strudwick's lengthy criminal history of continued offending, which in the last five years included eight drive whilst disqualified charges and one drive while suspended, the court heard.
"You've received section 10 bonds, large fines, received lengthy periods of disqualification, received community corrections orders and you continue to say to police, 'just so you know I don't have a licence', you're fully aware," he told the court.
"You've been given so much leniency over the past, I mean in every shape and form, by way of good behaviour bonds etc., but yet you still don't get it."
Mr Strudwick was disqualified from holding a drivers licence for 12 months, and sentenced to a fixed term of imprisonment for four months.
He will be released February 6, 2021.
