A man who pleaded guilty to a North Nowra home invasion in which another man was stabbed and gunshots fired has been jailed for 10 years. Benjamin Allen Hand, 45, pleaded guilty to multiple charges in Nowra District Court, including attempting to discharge a firearm with intent to murder, wounding a person to cause grievous bodily harm, recklessly using a firearm (firing at a building), possessing and using a prohibited firearm and aggravated entering a dwelling with intenrt. Police alleged Hand and co-accused Nickolas Hardes, now 35, went to the Goolagong Street address around 11am on June 11, 2017, forced their way into the home and attacked a then 37-year-old male resident. Court papers said Hand was armed with a home-made gun and a knife. The victim was asleep at the time but woke to a knocking on his locked bedroom door. Police said the victim opened the door, recognised the two men, and as he turned back toward his bed was hit in the back of the head with a blunt instrument and fell to the ground. He was stabbed twice by Hand, once in the middle of his chest and in once the lower section on his abdomen. The victim told police he stood up and Hand and Hardes were both standing in shooting poses, Hardes with a shortened .22 calibre firearm and Hand, with what was described by police as a mini Uzi which appeared to be handmade. In a scene like something out of the Wild West, police said the men fired their weapons but both failed to discharge. One of the men was heard to say "you're dead mate" as he pulled the trigger but it didn't fire. The court was told one of the guns was reloaded but again failed to fire. Police said both men pulled their triggers two or three times but the guns again failed to fire. Hand and Hardes ran from the property, while the victim, bleeding profusely, went to the front of the home where he grabbed a shortened 410 shotgun and fired a shot towards the two fleeing offenders. Court papers said one of the men fired back hitting brickwork next to the front door. The men were last seen running down Goolagong Street to a waiting car. The victim was treated by ambulance paramedics and was later airlifted to St George Hospital for surgery. Investigations led police to Hand, who was arrested on July 7 on unrelated matters. Court papers said Hand revealed during a recorded conversation with two women, that "the gun jammed and he had to whack him with the knife". Hand stated he "put two in him but he f....n fired at me and we fired one back." Police later attended a Nowra home and found a homemade firearm in a plastic bag buried in the garden. Hand admitted he had bought the firearm but claimed it was after the incident and had not taken the weapon to the North Nowra home. Judge Chris O'Brien sentenced Hand to an aggregate sentence of 10 and a half years, with a non-parole period of seven years. He will be eligible for release in July 2028. Nicholas Jeremey Hardes, 35, of Nowra, is still before the courts and has not entered any pleas to charges including discharging a firearm with intent to cause grievous bodily harm, aggravated entering a dwelling with intent to wound, wounding a person with intent to cause grievous bodily harm, cause a wound grievous bodily harm with intent to murder and carrying a cutting weapon upon apprehension.
