On Monday in Orange Local Court relieving magistrate Roger Clisdell called Department of Family and Community Services (DoCS) staff to court to find a foster home for the boy who was distressed during the court proceedings.
Police had taken him into custody at Cowra on Sunday saying he was not being properly supervised while he was on bail waiting to come before court on several charges.
He slept the night in police cells in Orange.
However after DoCS staff were ordered to court on Monday by the magistrate, a spokesperson for the department told the magistrate there wasn’t sufficient time to find accommodation for the boy.
The magistrate reluctantly sent the boy to the juvenile detention centre saying while it was his priority to keep the boy safe, he was too young to be in custody.
He then adjourned the case to come before him on Tuesday at Mudgee Local Court.
On Tuesday a family member came forward who satisfied the police and court criteria for appropriate supervision and the boy was released on bail.
