Alluvium Consulting responded to a public call for tenders by Dubbo City Council.
The contract up for grabs was for the design of a rock ramp and fishway at the South Dubbo weir, where two teenagers have died since 2008.
The council committed to the $4.4 million safety project in March, aiming to have construction completed by the summer of 2015-2016.
The response to the call for tenders was considered at the council's works and services committee meeting this month in a session closed to the press and the public for commercial-in-confidence reasons.
The committee recommended the council not accept the sole tender from Alluvium Consulting, according to the minutes from the meeting.
It also recommended that it should not invite fresh tenders due to only one being received in the first round.
Instead the council should enter into negotiations with Alluvium Consulting because "not all requirements of the specification were met" within Alluvium Consulting's tender submission and a peer review had identified shortcomings.
Subject to the successful resolution of issues identified, the general manager should be authorised to enter into a contract with Alluvium Consulting for the design of a fish ladder, the committee also recommended.
The council accepted the proposals endorsed by the committee at the ordinary meeting of the council on Monday night.
