Grant Robert Hughes is charged with dangerous driving, negligent driving occasioning death, entering enclosed land without a lawful excuse and not giving particulars to police.

In Orange Local Court, his solicitor Mason Manwaring said his client had not been served with a completed brief of evidence and could therefore not enter a plea in the matter.

The crash occurred about 9.10pm July 28, 2015, and resulted in the death of 75-year-old Millthorpe man Mirko Barbaric.

Police allege Hughes was driving a white Toyota Landcruiser "in a manner dangerous" when it crashed causing Mr Barbaric's death.

The Director of Public Prosecutions (DPP) has taken over the criminal proceedings after a crash investigation by the Metropolitan Crash Investigation specialist unit.

DPP solicitor Michael Fay said on Monday the crown had not supplied the full brief of evidence to the defendant because it was awaiting results from a forensic test.

At the time of the crash police said Mr Barbaric was heading east on the Mitchell Highway, near Lucknow, when the utility, travelling in the opposite direction, crossed to the wrong side of the road and hit him.

Witnesses at the accident scene told police the driver seemed confused and dazed after leaving his vehicle, which had flipped onto its roof.

Hughes allegedly fled the scene of the accident and made a bed of hay in the cabin of a tractor on a property on Beasley Road in Lucknow.

Emergency services spent several hours following the crash searching for Hughes in the area around the crash site before PolAir was called to the scene.

Hughes is expected before Orange Local Court in two weeks to reply to the full brief of evidence.
