Four years after the case it's understood an internal NSW Police inquiry found police officers senior constable Carl Giusti and constable Frank Shields had not followed proper police procedure.
Western Region Commander assistant commissioner Geoff McKechnie was in meetings on Tuesday and unavailable for comment.
A solicitor acting on behalf of Mr Shields said he would appeal the decision to the NSW Industrial Commission. The Daily Liberal understands Mr Giusti will do the same.
Both officers were said to be unhappy with the decision.
In 2013 senior constable Carl Giusti and constable Frank Shields were found not guilty in the Dubbo District Court. There were emotional scenes in and out of the court at the time.
The two-year-long wait for a trial into the alleged incident in Wellington had put the lives of both officers on hold.
Their harrowing trial came after a 14-year-old boy accused the pair of placing him into a headlock at Wellington’s skate park before being pushed into a police vehicle, taken to the side of a river and assaulted on Sunday, August 7, 2011.
Shields and Giusti had both pleaded not guilty to charges of taking/detaining in company with intent to gain advantage and assault occasioning actual bodily harm.
Twelve days of evidence presented 29 civilian and 18 police witnesses.
On day 13 of the trial, it took just two hours of deliberations for the jury to come to a decision.
They entered deliberations mid-morning after Judge Gordon Lerve summarised the overall proceedings.
