No pleas were entered on behalf of Brian Francis Townsend, 43, of Dubbo during the brief mention.
Just a day earlier Townsend was charged with murder and causing grievous bodily harm with intent to murder.
The victim - who died early on Sunday at Dubbo Hospital - was 63-year-old George Friar Cornell, court documents revealed.
Yesterday as the matter came before the court, police tape remained at the Macquarie Street unit where Mr Cornell was found with serious head injuries about 11.30pm on Friday by police responding to reports of an assault.
Townsend, arrested at the scene, is charged with committing the offences between 10pm and 11.30pm on Friday.
The accused was not present at the court yesterday but he had legal representation from the Aboriginal Legal Service.
Townsend, in custody at Wellington jail, had asked not to appear and there would be no application for bail, his solicitor said.
The Director of Public Prosecutions (DPP) representative asked that December 22 be set as the date for the brief of evidence to be served and January 5 for reply.
Magistrate Alison Viney ordered the brief to be served on the requested date and adjourned the charges until January 5.
Bail was not applied for and was formally refused.
Earlier there was a delayed start when two local court sittings had to be accommodated at the Dubbo court precinct.
