An application was made in Dubbo Local Court yesterday to have the alleged victim called to give evidence in court.
Lyndon Edwards is charged with maliciously damaging property by fire and taking/detaining a person with intent to obtain advantage.
Magistrate Howard Hamilton ruled the alleged victim would not have to come to court and give evidence because her statement reflected what she initially alleged to police on the day of the offence.
The application was made on the basis that there were differences in her statement in relation to when Edwards allegedly obtained a knife and what he did with it.
The grounds for the application also relied upon the victim’s allegation Edwards had threatened to rape her in a more recent police interview.
However, Magistrate Hamilton said the alleged victim had made that complaint on October 30 last year, the day of the alleged incident.
He said the allegation fell “far short” of a substantial change in the statement and said there was nothing to warrant calling her to court.
The matter was adjourned until May 31 for committal and bail was continued.
