Tye Charters, 20, had been drinking at the South Dubbo Tavern on December 23 last year, when staff asked him to leave because of his level of intoxication and unruly behaviour.

In an agreed statement of facts, police said Charters had verbally abused staff and refused to leave, before the pub owner intervened and he finally left.

However, while outside Charters walked near the drive-through bottle shop and began to urinate.

The pub owner again asked Charters to leave. Charters shouted "f--k off" and continued to urinate.

Police said when Charters finished, he got in the back of a car parked at the pub. The pub owner asked him again to leave and Charters got out and ran toward him.

The pair began to wrestle, and in an attempt to stop Charters assaulting him, police said the publican put him in a headlock while he was on the ground.

Charters managed to gouge the publican's left eye and nose, and also bite him under the left arm and chest several times.

Court documents said Charters was "trying to get the victim off him, as he was having a panic attack and couldn't breathe".

When Charters managed to break free he ran off along Boundary Road before police arrested him and took him back to Dubbo Police Station.

While in custody, Charters made threats to two female police officers.

"You wait till they open that door, you're gone," he said.

"I'm gonna stab you and gonna f--k your mother.

"I'll find you and I'm gonna rape you both."

In Dubbo Local Court Charters pleaded guilty to assault, being an excluded person failing to leave a premises, intimidating police and offensive behaviour in a public place.

The matter was adjourned by Magistrate Theresa Hamilton, and a sentencing assessment report was ordered.

The matter will return to Dubbo Local Court on October 29 for sentencing.
