Luke James Withers, 33, and his mother Sharon Withers, 52, appeared in Dubbo Local Court on Wednesday for sentencing, after their drunken night at the Amaroo Hotel on December 13.

According to court documents Ms Withers had been asked to leave the hotel as she was overly intoxicated and disorderly.

Ms Withers began arguing with the hotel manager who had asked her a number of times to leave, before her son, Mr Withers, became argumentative too.

The pair were both asked to leave before a number of security guards helped to "forcefully remove" the mother and son from the venue.

While outside Mr Withers began to violently pull on the door handle, while Ms Withers tried to get back inside the pub.

Shortly after Mr Withers approached a taxi and was refused a fare, before becoming engaged in an argument with another victim who he attempted to punch, but missed.

When the man tried to fight Mr Withers, they were split up by security, however both looking at each other in a strafe motion, Mr Withers took off his shirt and tried to start another fight.

As the pair were being held by security, Ms Withers unsteadily walked toward them before falling over on her face.

Mr Withers broke free from the people holding him back and began fighting with the victim, he was out to get.

After the altercation ended, Mr Withers broke free again sprinting down the street toward the man, where they punched on again.

When police arrived they saw Mr Withers was not wearing a shirt, had a stream of blood coming from inside his nose and was bruised around his face. They also saw Ms Withers lying on the ground next to the bench in pain.

The pair were treated by NSW Ambulance paramedics and Ms Withers was taken to Dubbo Hospital due to the injuries sustained from the fall.

On Wednesday Mr Withers pleaded guilty to one count of affray and one count of refusing to leave a venue while intoxicated.

Mr Withers' defence lawyer Anne Hazleton said it was a "most unusual matter", however references from Mr Withers' employer tended in court said he was a "hardworking" employee.

"Both of them appeared to have had too many drinks," she said.

"[Mr Withers] served some time in custody in 2015, he came out of that time in custody and managed to effectively rehabilitate himself from the drugs on the basis that he never wanted to go back into custody.

"He clearly suffers from an addiction to drugs and alcohol."

Representing herself in court Ms Withers pleaded guilty to failing to leave a premises while being intoxicated.

She told the court she noticed the security guard following her around, and claimed she was never asked to leave the pub.

"I walked myself out of the premises," she said.

"There was an altercation between my son and the security guard.

"All I remember is the security guard picking me up off the ground."

Magistrate Theresa Hamilton convicted Ms Withers and fined her $200.

Mr Withers was also convicted and placed on a 12-month community corrections order and fined $200 for failing to leave the pub.
