Christopher Eakin, 37, was refused court bail at Dubbo Local Court after Magistrate Greg Grogin said there were no further conditions he could impose that would protect the community.

"He's already under the strictest electronic monitoring," magistrate Grogin said.

Eakin, who was convicted of possessing child abuse material, was released from prison on December 15 last year.

He was placed on a final child protection prohibition order and made a registered person. Under the order he was required not to loiter or remain near a premises frequented by children or where children are known to be, or attend or be in the vicinity of any public swimming pool.

Eakin found himself back in custody after allegations that on January 19, little more than a month after this release from prison, he had breached two of the 12 conditions of the prohibition order.

The court heard Eakin was in Narromine hanging around Rotary Park for about 25 minutes, before heading to the Narromine Aquatic Centre.

It's alleged he stayed at the pool for about an hour, remaining one to 200 metres from the pool.

The court heard he was contacted by his case officer, as he was subject to an electronic monitoring bracelet, before police found him at 4.19pm on Burroway Street opposite the pool, where he had remained for about 10 minutes.

It's alleged Eakin told police he didn't pay attention to his surroundings, before telling them he hadn't been thinking clearly.

Defence lawyer Carmen Just told the court Eakin had already been subject to strict supervision, electronic monitoring and reporting twice weekly to Dubbo community corrections.

Ms Just also said he has been attending drug and alcohol counselling through NSW Health and had engaged with Marathon Mental Health in relation to some mental health issues.

Magistrate Grogin however found there was an unacceptable risk endangering the safety of the community and refused bail.

"He's only been on a prohibition order since December 15, and within a month these allegations of hanging around a pool and a park," magistrate Grogin said.

"I don't know how a person could say they hadn't been thinking when they have an electronic bracelet around their ankle.

"There are no other conditions that I could impose that would protect the community."

The matter will return to Dubbo Local Court on February 3 where it's expected pleas will be entered.

The court heard in 1998 Eakin was also convicted of aggravated sexual assault of someone under the age of 16.
