Senior Constable Corey Ahling, 38, was charged with assault occasioning actual bodily harm and two counts of common assault last year.
The assaults allegedly took place in Wellington in December 2018 while the senior constable was on duty.
The senior constable was served with a court attendance notice in the McDonald's West Dubbo car park on November 6 last year and advised to attend Dubbo Local Court on Wednesday.
He never appeared but his legal representative said not guilty pleas would be entered.
The legal representative did not say why the senior constable was not at court or where he was, when asked by magistrate Gary Wilson.
"If he's not here on the next occasion a warrant will be issued," magistrate Wilson warned.
The case returns to court on March 11.
