Drew Phillip Irwin, 35, of Dubbo, was sentenced to nine months behind bars when he appeared in Dubbo Local Court in July.
He appealed the severity of that sentence in the Dubbo District Court on Thursday.
Judge Stephen Walmsley ruled the sentence could be served in the community, by way of an intensive corrections order.
Irwin was also ordered to undertake 60 hours of community service work and disqualified from driving for 12 months.
He was further forced to install an alcohol interlock device - which stops a car from starting if the driver is under the influence of alcohol - for four years.
Court documents revealed when Irwin was caught drink driving on February 2 in Dubbo he had already been caught three times before.
He pleaded guilty and the court was told he was being treated for mental health challenges.
