A Dubbo man who was sent to jail for punching his partner in the face, resisting a police officer who tried to arrest him and breaching apprehended violence and conditional release orders will not spend any further time behind bars.
Visiting Magistrate Roger Prowse sentenced Allan Champion to a 20 month term of imprisonment in Dubbo Local Court on May 22.
The 25-year-old immediately lodged an appeal on the grounds that as a punishment, the sentence was too severe.
After a spending several days in jail Mr Champion was granted bail until his appeal hearing could take place in Dubbo on Tuesday in the District Court.
Judge Philip Ingram upheld Mr Champion's severity appeal.
He sentenced Mr Champion to maximum term of imprisonment of 12 months, which was to be served by way of an intensive corrections order.
An intensive corrections order is a type of prison sentence served in the community.
