Visiting Magistrate Roger Prowse sentenced Allan Champion to a 20 month term of imprisonment in Dubbo Local Court on May 22.
The 25-year-old immediately lodged an appeal on the grounds that as a punishment, the sentence was too severe.
After a spending several days in jail Mr Champion was granted bail until his appeal hearing could take place in Dubbo on Tuesday in the District Court.
Judge Philip Ingram upheld Mr Champion's severity appeal.
He sentenced Mr Champion to maximum term of imprisonment of 12 months, which was to be served by way of an intensive corrections order.
An intensive corrections order is a type of prison sentence served in the community.
