AN UPSET 20-year-old man stood up and blew a kiss to the public gallery in Dubbo Local Court last week when he was denied bail on a string of offences related to alleged domestic violence.

Seth Harvey appeared before Magistrate Andrew Eckhold via audio-visual link from Wellington Correctional Centre.
Charges included: assault occasioning actual bodily harm; take and drive conveyance; - drive vehicle recklessly; - unlicensed driving; three counts of stalk/intimidate to intend fear of physical/mental harm; three counts of common assault; and three counts of destroy or damage property.
Harvey is alleged to have assaulted and intimidated his pregnant partner in an East Dubbo location over a period of nine weeks.
At one stage he is alleged to have placed the woman in a headlock, forcing her to struggle for breath.
Harvey appeared impassive on the court video screen as his solicitor attempted to get him released from jail on bail.
The solicitor said the alleged victim had retracted her complaint by statutory declaration.
Photographs were tendered to the court when Magistrate Eckhold asked if there was any physical evidence to back up the complaint.
Harvey asked to live in Queanbeyan if granted bail and offered to lodge bail surety of $500 without security.
The police prosecution opposed bail, citing five breaches of bail over a period of years and a history of violence.
The court heard Harvey was on two court-imposed bonds to be of good behaviour when the alleged offences were committed.
Mr Eckhold said complainants regularly withdraw complaints in situations of alleged domestic violence.
“She may have all sorts of reasons for withdrawing a complaint,’’ he said.
“Physical evidence presented to the court is consistent with the complaint.
“With a suspended prison sentence in place and physical evidence, bail is refused for the welfare and protection of the community.’’
Harvey appeared upset when bail was refused. He stood up and blew a kiss to the public gallery before resuming his seat in the prison audio-visual room.
Harvey will reappear in Dubbo Local Court on November 22.
