Timothy Yavion Demartino sat handcuffed in the dock dressed in worn jeans, white socks and a short-sleeved shirt.
The 53-year-old builder was charged with firing a 12 gauge lever action shotgun into the Naked Gun Tattoo and Body Piercing Studio in Lee Street, Wellington in the early hours of May 26.
He was also charged over the possession of an unauthorised prohibited carbine semi-automatic rifle and failing to keep firearms safely.
Drug charges included the possession and supply of trafficable quantities of the prohibited drugs cannabis leaf and amphetamine and the cultivation of 10 cannabis seedlings in a hydroponic set-up.
Demartino made no application for bail and his solicitor asked for an adjournment to Wellington Local Court on June 11.
Magistrate Howard Hamilton said the matter should remain in Dubbo and ordered Demartino to appear via audio visual link on June 9. Bail was formally refused.
Demartino’s defacto partner Jo Ann Rose Hillyar also faced the court on four charges of possessing cannabis and amphetamine.
The 28-year-old was visibly distressed as she was brought before Magistrate Hamilton in handcuffs.
The court was told Hillyar had no criminal history.
The defence conceded trafficable quantities of drugs were involved and if convicted, Hillyar could go to jail.
The solicitor said Hillyar and Demartino had been in a relationship for four-and-a-half years and had no children.
During their time together the couple had purchased, repaired and sold a number of homes.
The solicitor told the court Hillyar had three homes in Wellington, two with mortgages and one tenanted property owned outright.
“My client is in a position to put the property up as security if granted bail,’’ he said.
Magistrate Hamilton allowed Hillyar $30,000 cash bail on the condition that an accepted person also agree to deposit a similar amount.
Hillyar was ordered to live in Wellington, not approach witnesses, report to police daily and have no contact with Demartino.
She will reappear in Dubbo Local Court on June 9.
Hillyar and Demartino were arrested after detectives from Orana Command executed two search warrants on a house and business in Wellington.
Inquiries into the drive-by shooting and alleged vehicle rebirthing in the Wellington area are continuing.
