Two repeat drink-driving offenders have been taken off the roads of Dubbo after separate appearances in Dubbo Local Court yesterday.

Between them, 28-year-old Adam John Spackman and Anthony Wayne Toomey, 39, have nine prescribed concentration of alcohol (PCA) charges behind them, with Magistrate Allan Moore taking a dim view to this when sentencing the pair yesterday.
Spackman was first to appear and pleaded guilty to a charge of high-range PCA.
This matter was his fifth drink-driving charge since 1999.
Police facts tendered to the court stated that on February 14, Spackman was pulled over by police on Cobra Street.
At the time of being pulled over, it was stated he got out of the car he was driving and handed the keys to police, telling them “take these, I’m going to jail”.
A breath analysis revealed a blood alcohol reading of 0.190 with Spackman later admitted to police he had consumed 12 stubbies of beer.
In sentencing Spackman, Magistrate Moore said he took into account the defendant’s early guilty plea but said his history meant that no other course of action was possible.
“You went high-range in 1999, low-range in 2003, mid-range in 2003, high-range in 2005 and high range again,” Magistrate Moore said.
“I have no choice but to sentence you to a full-time custodial sentence.”
Spackman was sentenced to 12 months in prison with a non-parole period of six months ending on November 26.
In a separate matter, Toomey was told he was lucky not to be in full-time jail after pleading guilty to charges of high-range PCA and driving without a licence.
It was his fourth PCA charge but his first in 14 years, which Magistrate Moore said was the only thing that saved him from a full-time jail term.
Facts tendered to the court stated Toomey was involved in an accident in the early hours of October 30 which resulted in himself and his passenger at the time attending hospital.
At 1.25am, Toomey was driving along Erskine Street and was going through the Darling Street roundabout when he lost control of his vehicle, crossed to the wrong side of the road, mounted the kerb and run into a fence.
He proceeded to drive away before damage to the vehicle ensured it broke down on Cobborah Road.
Toomey pleaded guilty to the charges and for the unlicensed driving charge was given a fine of $500 plus court costs.
For the high-range PCA charge he was given a 15-month suspended jail sentence, disqualified from driving for five years and fined $1800 plus court costs.
He was also banned from attending licensed premises in the Dubbo, Parkes and Wellington areas.
