Cassandra Margaret Gibson, 37, was released from jail early this week after spending more than 50 days on remand on strictly indictable charges of discharging a firearm with intent to cause grievous bodily harm and robbery armed with an offensive weapon.
Gibson and co-accused Thomas Leslie Riley, 35, were arrested after police swooped on a house in Gregory Court, East Dubbo, at 7.15pm on April 30.
Their arrest followed a police investigation into a shooting at the Hans Clavan sporting field car park in Bligh Street eight hours earlier.
Riley remains in jail on charges of discharging a firearm with intent to cause grievous bodily harm, robbery armed with an offensive weapon, possession of a prohibited drug and possession of a restricted substance.
Riley was not required to appear on the prison audiovisual screen when the charges were brought before Magistrate Andrew Eckhold in Dubbo Local Court this week.
The Office of the Director of Public Prosecutions (DPP) asked for an adjournment for forensic testing. There was no application for bail which was formally refused.
Gibson appeared in court in person. The DPP asked for time to allow plea negotiations to continue. All charges were adjourned to August 8.
Prosecution facts tendered to the court allege Gibson and Riley were involved in a drug transaction with Trevor Stephen Pretty, 49, of Cobar, on April 30.
Police allege the parties arranged to meet in the Hans Clavan sporting field car park. Riley allegedly entered Pretty’s car and produced a sawn-off rifle from the front of his pants.
Police allege Pretty removed a plastic bag of amphetamine from his shirt pocket and told Riley he did not deal with guns.
When Riley allegedly asked to see the drug, Pretty placed a bag on the centre console of his vehicle.
Police allege Riley snatched the bag with his left hand and attempted to flee through the passenger door while holding the rifle with his right hand.
Police allege Pretty was shot through the upper thigh when the two men became involved in a physical struggle in the front of the vehicle.
Police allege Riley got back into the Starwagon before Gibson sped away. The court heard Pretty went back to his car and chased the Starwagon along Bligh, Talbragar, Macquarie and Darling streets.
Bleeding profusely, Pretty drove himself to Dubbo Base Hospital where police were called.
Pretty underwent surgery to remove a .22 calibre projectile from under his right knee.
The court heard Riley and Gibson were arrested at a house in East Dubbo.
A search revealed six Valium tablets and 0.2 grams of a substance alleged to be crystal methamphetamine.
Police allege the “ice” was secreted in Riley’s underwear.
The court heard Gibson remained at the house until police arranged emergency care for her disabled daughter Kaneesha.
The Misubishi Starwagon was seized for forensic examination.
