An appeal is expected to be lodged this afternoon in an attempt to allow the horse, which won the Group 3 Australia Day Cup (2300m) late last month, to compete in Saturday's Inter Dominion heats at Menangle.
The 12-year-old horse's fate, and most probably his career, is in the hands of a judge who will determine whether Lew is granted a stay of proceedings until the appeal can be heard.
It is the second time in the space of less than 12 months Lew has been disqualified for a positive swab, however the first case was quashed when it was found the sample had been contaminated.
