The boy, who will turn 15 next month, cannot be named for legal reasons. He faced Magistrate Howard Hamilton on a charge of assault occasioning actual bodily harm and also faced action over breach of bail conditions.

According to police facts, the girl was riding a scooter in Columbia Drive at 7pm on Thursday when she was allegedly assaulted. Police said the girl required treatment for a cut forehead.

Magistrate Hamilton was told the accused had no relationship with the alleged victim. Police said after the alleged assault the accused ran off with a group of friends.

The Aboriginal Legal Service applied for bail and said the boy was prepared to remain in the constant company of his father when he was not attending school.

The defence solicitor conceded the boy had breached bail for earlier offences by associating with a co-accused at the Dubbo show.

The solicitor asked for a Juvenile Justice background report.

Police prosecutor Sergeant Simon Madgwick opposed bail.

“He was given bail for another serious offence three days ago and has now breached bail again,’’ Sgt Madgwick said.

“He has admitted punching the girl in the face and has a pattern of non-compliance with bail.’’

Magistrate Hamilton refused bail and ordered the boy to remain in custody.

“This is his fifth breach of bail,’’ Mr Hamilton said.

“He has pleaded guilty to assault occasioning actual bodily harm and as I understand his record he was on bail and probation.

“He was last before this court on May 10 in relation to a breach of bail. Bail was allowed and the consequences of breaching bail again were clearly explained.

“He has then committed a further offence unprovoked.’’

Mr Hamilton adjourned the matter to June 6 for sentence.

According to court records, the boy is already scheduled to be sentenced on other charges including intent to commit indictable offence enter inclosed lands without lawful excuse and carried in conveyance taken without consent of owner.
